"Pertinent Intellectual Evidence" - At Boots In Action Services, we begin by conducting a comprehensive record review, obtaining all claimant’s available information. We then review all VA and private medical records, highlight relevant diagnoses and treatment notes, and coordinate with the veteran’s healthcare providers to obtain detailed information to form a nexus expressly linking their current condition to their military service—ensuring compliance with VA standards. Next, we organize lay statements from family members, supervisors, and fellow service members—each signed, dated, and containing firsthand observations of symptoms and functional limitations. All evidence is compiled into a logically structured packet (Service Records, Medical Records, Nexus Opinion, Lay Statements, Work/Social Impact) to facilitate rapid VA review. We also address any evidentiary gaps or credibility concerns by referencing legal precedent (e.g., Buchanan v. Nicholson) and explain how each document supports the required elements of service connection.” Understanding the 38CFR's can be very crucial in getting claims awarded no matter the stage of the process.
Discussion of risk assessment from gathered information to formulate a strategic plan. This is the time to look at all possible pitfalls and setbacks that may arise and counter prior to filing. Removing the assumptions that your claim is solid allows for flexible pivots when necessary. Much like chess, it helps to know your opponent and how to use the pieces on the board. Ignorance of the VA claim process is often the reason for misplaced hope. Having the medical reports, in-service issues, and even medical diagnosis may not be enough. The truth is many veterans are denied with that very formula.
